1. Acceptance of Terms

By accessing and using Modding Lounge ("the Service", "we", "us", "our"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Modding Lounge is a platform that allows users to share, discover, and download modlists (curated mod collections) and individual mods for video games. The Service includes file hosting, user profiles, community features, and related services.

3. User Accounts

3.1 Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must be at least 18+ years old to create an account (13 with the consent of a parent or gaurdian, not including NSFW content)

3.2 Account Security

• Notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage from your failure to maintain account security
• You may not share your account credentials with others

3.3 Account Termination

• You may delete your account at any time
• We reserve the right to suspend or terminate accounts that violate these terms
• Suspended/banned users may not create new accounts

4. User Content

4.1 Ownership and Responsibility

• You retain ownership of content you upload to the Service
• You are solely responsible for the content you post and the consequences of posting it
• You represent that you have all necessary rights to upload and share your content

4.2 Content License

By uploading content to Modding Lounge, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, display, and distribute your content through the Service
• Create derivative works (e.g., thumbnails, format conversions) as necessary to provide the Service
• This license terminates when you delete your content, except for cached or backup copies

4.3 Storage Limits

• Free accounts have a storage quota of 10GB
• Files larger than 5GB per upload are not permitted
• We reserve the right to remove files that violate storage policies

4.4 Prohibited Content

You may not upload, post, or transmit content that:

• Violates intellectual property rights of others
• Contains malware, viruses, or malicious code
• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Promotes illegal activities or violates any laws
• Contains personal information of others without consent
• Is spam, advertising, or commercial solicitation

5. Content Moderation

5.1 Automated Moderation

• We use AI-powered content moderation to detect harmful content
• Content may be automatically flagged, placed in draft status, or rejected
• You will be notified if your content is moderated

5.2 Strike System

• Violations result in strikes against your account
• 1st strike: Warning
• 2nd strike: 7-day suspension
• 3rd strike: 30-day suspension
• 4th+ strikes: Permanent ban
• Severe violations may result in immediate permanent ban

5.3 Appeals

• You may appeal moderation decisions by contacting support
• Appeals are reviewed within 7 business days
• Our moderation decisions are final

6. Copyright and DMCA

6.1 Copyright Policy

We respect intellectual property rights. If you believe your copyrighted work has been infringed:

• Send a DMCA notice to our designated copyright agent
• Include: identification of copyrighted work, location of infringing material, contact information, and good faith statement
• We will investigate and remove infringing content as appropriate

6.2 Counter-Notification

If your content was removed due to a DMCA notice:

• You may submit a counter-notification if you believe the removal was in error
• Include: identification of removed content, statement of good faith belief, consent to jurisdiction

6.3 Repeat Infringer Policy

Accounts with repeated copyright violations will be terminated.

7. Game Mod Distribution

7.1 Third-Party Content

• Mods and modlists often contain or reference third-party content
• You are responsible for ensuring you have rights to distribute mod content
• We are not responsible for copyright disputes between users and third parties

7.2 Game Developer Rights

• Respect game developer terms of service and EULAs
• Do not upload mods that violate game developer policies
• We will comply with takedown requests from game developers

7.3 Mod Dependencies

• Clearly document all mod dependencies and requirements
• Provide accurate installation instructions
• Do not bundle third-party content without permission

8. NSFW Content

8.1 Declaration Requirement

• You must accurately declare the NSFW level of your content
• Options: None, Mild, Moderate, Explicit
• Failure to properly label NSFW content may result in content removal and strikes

8.2 Access Restrictions

• You MUST be at least 18 years or older to view NSFW content
• Users must opt-in to view NSFW content via privacy settings
• NSFW content is filtered by default
• Explicit sexual content must be properly tagged

9. VirusTotal Scanning

9.1 File Scanning

• All uploaded files are scanned using VirusTotal
• Files with detected threats may be removed
• False positives may occur; you may appeal scan results

9.2 User Responsibility

• Do not attempt to upload files containing malware
• Intentionally uploading malicious files will result in immediate permanent ban
• We are not liable for false negatives in virus scanning

11. Disclaimers and Limitations of Liability

11.1 Service "As-Is"

• The Service is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted, secure, or error-free service
• We do not guarantee the quality, safety, or legality of user content

11.2 Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, special, or consequential damages
• Our total liability shall not exceed $100 or the amount you paid us in the past 12 months
• We are not liable for user content or actions of third parties

11.3 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your content
• Your violation of these Terms

12. Third-Party Services

12.1 External Links

• The Service may contain links to third-party websites
• We are not responsible for external content or privacy practices
• Use third-party services at your own risk

12.2 Integrations

• We integrate with services like Discord webhooks, Nexus Mods, etc.
• You are responsible for complying with third-party service terms

13. Changes to Terms

• We may modify these Terms at any time
• Continued use of the Service after changes constitutes acceptance
• Material changes will be notified via email or Service announcement

14. Termination

14.1 By You

• You may stop using the Service and delete your account at any time
• Deleted content may persist in backups for up to 90 days

14.2 By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Harm the Service or other users
• Create excessive load on our systems

14.3 Effect of Termination

• Your right to use the Service ceases immediately
• We may delete your content and account data
• Provisions regarding liability, indemnification, and disputes survive termination

15. Dispute Resolution

15.1 Governing Law
